amazing and as RARE as a steak right off the cow, for an fdc judge to reverse ssa alj's decision from a denial to an approval & no remand...

I am so glad I didn't read that before I got my letter stating that the FDC did in fact reverse the ALJ's denial in my case!   ;D  Now just waiting for the money honey   :P

Congratulations, think SSA counted on you not taking it there.

I think the federal courts are getting swamped with SSA cases and are over turning decisions, more people should take it to that level. I will if the AC denies me

This is your first post.  You may want to check your attitude at the door.  We are not that type of forum.  Try introducing yourself first.

Lets begin again shall we ?...... Hey Cottage, always happy to see you on the boards because you always share good information.

:Welcome01: :Welcome06: andocrates       :Other08:  nice to meet you and we're happy that you decided to join us . Although this is an open forum we consider Everyone who joins a part of our big family. The motto is You are no longer alone and we do our best to share information, give good advice and encourage one another. WE try very hard NOT to judge a situation or condition and disrespect or constant negative comments toward Any member will  NEVER be tolerated. Marci and the Moderators and most of the other members for that matter will see to it. We never  judge a person's condition ( that's not our job or purpose here) simply because a condition that one person may consider trivial may greatly and drastically disable another ..ie my sister has arthritis so severely that she at 46  is wheelchair bound and has very limited use of her hands and so in her case it is not ONLY JUST ARTHRITIS.
WE welcome you with open arms and invite you to share some of your SSA journey with us but only as much as you feel comfortable sharing. Hopefully as you read more you'll come to know that we are here to support and encourage each other . Who can do this better than others who have traveled this road or others who are currently negotiating this long and tiresome maze . TTFN (TA TA For Now) and Blessings!  :Happy07: :Happy06:

Hi everyone. My claim began in November 2008. The ALJ's decision in my case was reversed in March 2013. The case as far as i know is now at the Office of General Counsel. Does anyone know how long a case might take in that office after a favorable decision has been issued? Thanks for any help you can provide.   Brian

I got a letter of intent from the Appeals Council saying that they would approve my appeal with a changed EOD in thirty days. They said I could still submit new information about my original case, but if they didn't hear from me within thirty days, they would issue a partially favorable decision.

I think they AC must have said they will review the appeal in 30 days, because if they could already issue an approval based on your Alleged Onset Date, they wouldn't be requesting new documentation.

No. They said specifically that there was an error in law made and that while they agreed with the ALJ on all the other points, when I turned 55 the grid rules changed. They said that if I don't reply, they will approve me with the revised EOD of the day before my 55th birthday.😃
