letters from Appeals council
« on: February 25, 2022, 02:15:23 pm »
Hello,

I had gotten 4 letters from the appeals council a couple days ago after almost a year after my remand hearing. They re-remanded my case to a different ALJ due to the recording from my phone hearing had picked up sounds and the recording was not the best.  They also asked for another release form to get my updated records, and the forms for another hearing, and they gave me a choice of either another phone hearing, video hearing, or if I didnt want wither, they would schedule an in-person hearing.  I decided on a video hearing, and I will be sending out the forms in the morning.

I had appealed the last ALJ decision based on the fact that the ALJ still gig not consider obesity, the VE statements that there were no jobs available in the national economy for someone with my restrictions (including a note from a doctor in my PCP's group limiting me to 3 workdays a week, as well as elevating my legs for 15 minutes every hour), and the ALJ had also had stated in his decision that if I were a few weeks to months older it would change the decision from denied to approved.

I am very hopeful that this time they will approve me.  In the letters, it also stated that of they can approve me without a hearing they will, based on the evidence in my files.

I am hoping that they will either schedule my new hearing or approve me soon, as we are already barely scraping by, and if what is happening with our landlord they will be raising our rent by $450/month, as they are doing that with our neighbors when thaey are getting their lease renewals, and we won't be able to afford it, and every time we apply for rent assistance, we get passed over.
