Phone hearing tomorrow

After being remanded back from federal I have a phone hearing tomorrow morning.  Very nervous.  My original file date was aug 2016.   After denials.  Finally this. I turned 55 last aug.   my attorney emailed me today saying we would do best saying light duty at age 55.   Now this means no back pay. And my 56 birthday is aug. so will there even be money to pay attorney.  I completely don

Good luck at your hearing by the way. Is your attorney giving you a choice of what to fight for or did he/she just tell you what the strategy is going to be?

Even though losing all that backpay would suck, if that's what your best chance at approval is, benefits going forward is better than nothing. I'm unclear though if your attorney is still going to try to get you backpay or not.

Did the VE find any jobs to any of the hypotheticals? What kind of evidence do you have? Have you read it?

Yes. A floor cleaner  floor waxer a porter and salvage laborer and evidence is my medical records no lifting over 20lbs and with copd no air pollution such as cleaning stuff dust humidity cold.

If you do not receive back.pay. Your attorney will not be entitled to a fee. You might receive a bill for copies of medical records, postage, etc. Your Fee Agreement has that information. Your attorney is not allowed to bill you for his work on your case when there is no back pay.
