Title: Unbelievable
Post by: Disabledvet100% on March 27, 2022, 10:32:31 am
Long story short!
-My initial case filed in February 2019 was remanded by the Federal District Court in January 2022
- Meanwhile I started a new case in October 2020 because the Appeals Council denied my initial case
- On March 5, 2022 my second case went to the ALJ and was found fully favorable because I met Blue Book Criteria
- On March 25, 2022 I received a letter from the Appeal Council stating that my fully favorable case is a duplicate  and now they want me to go to another ALJ Hearing. per 20 CFR 409.952 and HALLEX 1-1-10-10
-WTF! I have been through 3 Judges and was found fully favorable and now SS is rescinding that case in order for me to see a 4th ALJ  (which is the first ALJ who denied me). This is just plain wrong and SS is stacking their deck to their favor!!!! They pulled the rug from under me. I'm so upset.

Maybe they want you to go to the ALJ hearing regarding the duplicate for the reason being to simply "close the case" as fully favorable.

I hope your right but that why make me go through it at all? The AC has the right to just approve my case.

So, the Hearing Office supervisor is really baffled why they are trying to revoke my fully favorable judgment.  It seems some clueless employee just tried to delete my entire fully favorable case.  This can't be made up!!! They could just have combined my second case with my first case but now I may have go to another hearing.

The good news is that if I have to go to ALJ again, it's the one who found me fully favorable and not the one who wrongfully denied me in the first place.

Silver linings at least?
