Had My CE Exams on Friday June 24th
« on: June 26, 2022, 03:25:32 pm »
Well, this is my 3rd go around with Social Security Disability. I'm now 58 years old, and will be 59 in October, so I hope that makes a little bit of a difference this time.
I had a mental status exam as well as a physical exam with an internist.
The first appointment was with the psych doctor, and the first thing he said to me was, "You are already disabled through the VA, is that right?" I told him yes, and he asked me what percentage which is 50%. I had this same doctor a few years ago when I applied last, and he seemed different this time. Last time he hardly looked at me, but this time he would ask me questions about something and I would answer, and he would finish my sentences with in a positive as to why I was feeling that anxiety of feeling, or thought. He actually looked at me this time. He explained the math questions are asked to see if I can handle my own finances. But, all in all it was pretty standard like the last time. He did say that he felt that I can probably get jobs, but that keeping jobs is a whole other story because I cannot handle the pressures of work environments.
Then off to the Internist. He was rushed and made sure to tell me that if he felt I was faking it, he would write that too. I'm not faking my Degenerative Disc Disease, My osteoarthritis, my Lupus, or any of the other medical issues I have going on. I just straight out told him "I don't know" when he asked me questions I didn't know. Then the heel to toe test came along, and I could not do that and haven't been able to do that for quite a while, ( I look like a drunk trying to walk a straight line) and from that point on he slowed down and didn't seem as rushed with me. I really don't expect him to help my case along any, but I do hope!
Just thought I would share this experience with the CE process. I just dreaded it the whole time once I received notice that I was set up for them. I guess in a few weeks I will be able to give an update as to if I made it through positively or negatively.

Hope all goes well with this appointment you had. I  don't know why social security feels like their doctors know more than the ones we go see on the regular. I did that exam back in 2017 and again in 2019.
I think both doctors said I could work but Va had already said I couldn't.
The doctor I had to see about my back and knees said he didn't see anything wrong with me. Guess he had exray vision with his eyes 🙄.

That's too bad! The doctor could have at least ordered a test of some sort for you.
I had both exams. The first doctor said that he felt that I could get a job but would not be able to keep it. He also threw in that it's their decision. The second doctor wasn't very friendly. He seemed rushed. I had a hard time walking heel to toe without looking like a drunk, but since that is not a normal every day walk, I'm sure it won't count for much.
The social security page shows they are 48% complete with their decision.

I really hope you get it...thank you for your information.I am new to the site.I still have my physical ce exam to go,and my nerves do settle down with the information I read. Does it mean anything that my online status is at 56% and I still have the exam to go?

SSA doctors do not order tests for you.  If a test is needed for your claim, it is ordered by DDS.  But even if the doctor says you need you have X test to assess Y, they cannot order for SSA to pay for it.

That makes sense, I didn't think about that.

Thank you, I hope so too!! As for how they figure out the percentages of where they are at in the decision process, I have no clue. Mine ticks up 1 percent every day except Sunday and holidays. Today I am at 49%.
And yes, reading all the information here does help to calm the nerves. It kind of gives a snapshot of what can be expected at the exam. Good luck to you and keep us posted if you wish!!

The VA criteria for disability and SSA's is different. After a diagnosis has been made. the view shifts to how the impairments affect your ability to perform Activities Of Daily Living. Details Matter. Have you discussed these details with your doctors ? Did you get copies of your medical records and read them to be sure your doctors noted the details in your medical records? Did you give details when you filled out your Activities Of Daily Living form ? Do you have to use a electric cart when you grocery shop ? Does someone have to do your shopping for you ? Can you put your groceries up ? If you can, do you have to take breaks to sit or lay down before all of your groceries are put up ? No one is a mind reader. Five people can have the same impairments but the symptoms affect them in different ways. If someone helps you with grocery shopping, preparing meals, showering, or other things. They can fill out a Third Party Form.
Nerve damage in upper and lower extremities. Degenerative Disc Disease, RA.

Hope the size of a mustard seed can produce Faith that can move mountains.

Thank you Just Me,
Yes, I know the VA is different than Social Security. I'm 50% with the VA for PTSD due to MST, mood disorder and chronic depression. I have more issues on the psychological issues than I do on the physical. I just saw that they said to put every thing down that I have been diagnosed with. I don't know how much of their notes they sent to Social Security from the VA Health Care System, but I'm pretty sure they sent them a cd which is how I received my medical records when I asked for them. I have a boatload of as I have been going to the VA since 1994. From what I understand, the VA will not respond to any correspondence from Social Security other than sending medical records. I was told several years back that they no longer fill out forms for Social Security. This is my 4th time trying for SSDI

When you say this is your third go 'round with SSA, what exactly do you mean? How far did the previous two go? It reads to me that you are on your third separate application, but I just want to be sure.

Also, do you have, or plan to get, an attorney?
Los Angeles, CA

Short Version: Filed June 2012 at age 46; major depression + general anxiety. Denied all the way. Fed district court remanded, 2nd hearing delayed twice (11 months total delay). Bench approval at remand hearing in March 2017. Took over six months to receive closed-period award pymt.

The last time I had an attorney. The only thing he was good for was taking up space during the hearing with the judge. The attorney said nothing, he just sat there. I only appealed it that one time. If denied again this time, I don't know if I want to play the waiting game again as it really causes even more added anxiety.

My first attorney was useless and didn't prepare for the case.  The only thing she stated during my hearing was to the VE and asked how many days can one miss that is acceptable to an employer.  My second representative rocked and had an opening statement and requested an OTR!
Initial 09/19 Recon 3/20
ALJ 06/20 AC 10/20
Federal 10/20
New app 10/20 Recon 10/21
ALJ approved 3/22 then vacated
Fed Remand 1/22
Fed and ALJ combined: Won via OTR 7/22
