Are you allowed to work while you apply for Disability?
« on: September 01, 2009, 07:40:51 pm »
What are the rules regarding employment and applying for Disability?

Can you work at all after receiving Disability? Even a few hours a week?
I speak from experience not expertise.

According to Social Security, while applying for Disability Benefit as long as you are unable to engage in "substanstanial gainful activity" you are eligible for benefits.  That means you are unable to work or work and earn over a certain amount.  That amount changes each year.  For 2009 it is $1640 if you are blind and $980 if you are not, and for 2010 it is $1640 if you are blind and $1000 if you are not.

After you receive benefits they have a program called ticket to work where you can earn money and get back to work you can read about that program in a different section of this forum and they also have a trial work period.

During a trial work period, a person receiving benefits may test his or her ability to work and still be considered disabled.   You can work 9 months in a 60 month period. In 2009, any month in which earnings exceed $700 is considered a month of services for an individual's trial work period. In 2010, this monthly amount increases to $720.

Please contact Social Security to verify this information and again, any work is always I feel looked during reviews so keep that in mind.

Mark consider however that the rules also state that IF you are deemed disabled, and before the 24th month of benefit you begin to work you will be subjecting yourself to an automatic and full Medical Review. IF you are over the 24th month and begin to work using the ticket to work program then the above is correct and the chances of medical review will be as if you had never used the ticket.
