Hi everyone, I had a few questions, first a little back story on the SSDI part,in Jan 2017 I applied for ssdi, was denied of course, appeal, hearing and approval took about 11 months.
Now onto to the VA side. I was granted a combined rating in 2015 dating back to 2013 for mental and various physical problems. Since the rating was so high they automatically for TDIU. So in Feb 2016 I get a letter to sever mental health issues as a CUE, for being prior conditions! That letter was sent Feb 19, Feb 28 I filed the usual nod and asked for a hearing. It was ignored. My rep sent in multiple nod and requests following all the way until Aug. They severed my benefits no hearing, no c and p, Nothing. My rep was then relocated so I had to hire a lawyer.
I lost my home, car and credit after this, I was 6 months pregnant with two older children. I have no real family support so things were rough for awhile.
I finally had my DRO hearing last weak, the guy was great. We decided on an informal as the first words out of his mouth was what they did was illegal. Besides not giving me due process, they had no justification for severing comp. The rates gave her opinion not facts, had a medical opinion done without my full record, history or medical issues. He apologized many times. He said that it will be reinstated and will do a quick check on some things for tdiu as well. The last c and p exam I had was also flawed and should have been rated higher upon his reading of it. So have to do another c and p, they were under 2 different appeals.
Since it was informal, I'm told things can go quickly, how quickly has this happened for them? I was told they don't give bench decision but this guy pretty much did.
I know it's a waiting game but I have been waiting and am sick of it. Sorry so long.
