Help a Veteran understand
« on: December 13, 2016, 07:40:10 am »
My Name is Barron and I am a 90% service connected payed 100% due to being unemployable veteran. I have been diagnose with Spinocerebellar ataxia I have file for ss benifits over 3 years ago. If I could better understand the process maybe it will not be so bad if I understood why my case is taking so long. Any thoughts would be appreciated   I need help.

Perhaps you could be more specific about what you need help with?  If you fill out the bio info and do a post introducing yourself and explaining your journey thus far, that's usually a good starting point.

"I have file for ss benifits over 3 years ago."  Original post this thread.

And you have never received a determination??  That sounds most unusual.  Have you contacted the Disability Determination Service worker who has been handling your case for THREE YEARS?

"...I am a 90% service connected..."  Ibid.

That and $2.00 will get you a soda out of a machine.  Yes, SSA will certainly look at the medical records that made the VA deem you disabled but meeting the VA definition of disability is different from meeting the SSA definition of disability.  (See  https://www.ssa.gov/redbook/eng/definedisability.htm)

A diagnosis does not equal meeting the SSA definition of disability.  How does YOUR Spinocerebellar ataxia affect YOUR ability to perform Substantial Gainful Activity?  Have you reviewed Listing 11.17 (https://www.ssa.gov/disability/professionals/bluebook/11.00-Neurological-Adult.htm#11_17)?

Again, what have you done to follow up on your case?
